1. Introduction
– These Terms and Conditions of Sale (hereinafter “Terms”) govern the offer and sale of services provided by Capri Hydro (hereinafter “Provider”) through the website caprihydro.com, through the headquarters in Capri and through any other third party vendor. By accessing the site and booking our services, the user (hereinafter “Client”) fully accepts these Terms. Therefore, we invite you to read them carefully before making a reservation.

2. Services Offered
-Capri Hydro offers water experiences, including kayaking and paddleboarding tours, as well as land experiences such as trekking and hiking. The details of each activity, including duration, itinerary, and requirements, are specified in the relevant descriptions on our website.

3. Participation Requirements
– To participate in our land-based activities, it is mandatory to have adequate physical preparation, which is necessary to safely engage in sports activities. Additionally, to participate in our water activities, it is required to know how to swim.
– Before the start of the activity, each participant must sign a written declaration at our headquarters attesting to these abilities. Additionally, some activities may have specific requirements, such as minimum age or particular physical conditions, indicated in the descriptions of each experience.
– The experiences sold by Capri Hydro cannot be offered to individuals weighing more than 120kg (Capacity limit required for our equipment) and/or with serious health conditions.
– To participate in water experiences involving the use of a vessel (both rowed and motorized), it is necessary to sign a boat rental contract, in accordance with Italian regulations (at no additional cost), at our headquarters before taking part in the activity.
– Minors must be accompanied by a parent or legal guardian, who must sign a waiver at our headquarters before participating in the activity.
– Capri Hydro reserves the right to refuse participation in its tours to anyone under the influence of drugs/alcohol or any passenger who poses a threat to staff or guests.

4. Bookings and Payments
– Bookings can be made through our website or at our headquarters or through third-party sellers. At the time of booking, a deposit or full payment is required, as specified during the purchase process. Accepted payment methods include credit cards, bank transfers, and other methods indicated on the website.
– Upon completing the booking, the organizer or seller provides the client with a copy or confirmation of the contract on a durable medium.
– The traveler is entitled to a paper copy if the contract was concluded in the physical presence of both parties.
– For contracts negotiated outside business premises, as defined in Article 45, paragraph 1, letter h) of Legislative Decree 206/2005, a copy or confirmation of the contract is provided to the traveler on paper or, if the traveler agrees, on another durable medium.
– The booking of the experience is considered finalized, and the contract concluded, only when the provider sends the voucher, including via electronic means, to the client or third-party seller.
– The client must inform the provider before booking about any specific requests, which are considered part of the contract only if feasible and documented in writing in the contract and accepted by the organizer.
– The ticket for the experience (e.g., voucher) will be delivered to the client upon booking confirmation. The client is responsible for verifying the accuracy of the details on these documents and must immediately report any errors to the seller. The client must provide the organizer with participant details exactly as shown on personal identification documents.
– The itinerary may be subject to changes depending on marine weather conditions and nautical traffic.

5. Name Change, Cancellation Policy, and Modifications
– Name changes are always allowed and can be communicated directly at our headquarters before the experience begins.
– To cancel or modify a tour, clients must contact our offices via email at info@caprihydro.com.
– Tour date changes are permitted if requested at least 24 hours before the scheduled departure.
– If a cancellation is requested at least 24 hours before the scheduled departure, the full amount will be refunded.
– If a cancellation/modification request is made less than 24 hours before departure, no refund will be issued, and no modifications will be allowed.
– No refunds are provided for “no-shows.”

6. Cancellation by the Organizer (Capri Hydro)
– The organizer reserves the right to withdraw from the contract and cancel the tour or rental in case of adverse weather conditions or any other event preventing the regular execution of the planned activity.
– If the tour or rental cannot take place, all potential participants will receive a notification via email or WhatsApp, offering the following options:
1. Full refund of the paid amount;
2. Replacement of the booked activity with an alternative of equal cost;
3. Rescheduling of the booked tour to a later, compatible date.

7. Main Obligations of the Client
The Client agrees to:
– Follow the instructions provided by the Capri Hydro staff.
– Properly use the provided equipment and return it in the same condition.
– Not appear under the influence of drugs and/or alcohol.
– Declare to be physically and mentally fit, free from illnesses, and suitable for outdoor experiences. The client also declares to be in good health and not to have any physical and/or mental impediments to sports practice, such as heart conditions, high blood pressure, fainting spells, musculoskeletal deficiencies, respiratory diseases (e.g., asthma, emphysema), neurological disorders (e.g., paralysis, epilepsy), significant psychoses/neuroses, pregnancy, or the influence of medications, drugs, and/or alcohol. The client takes full responsibility for having undergone necessary medical checks.
– Observe common rules of good behavior and prudence, as well as all instructions provided by the responsible staff. Failure to do so may result in liability for any damages caused to Capri Hydro staff, other participants, or third parties.
– Exempt Capri Hydro and its technical staff (guides, instructors, supervisors) from any liability and compensation, except in cases of proven and evident fraud or gross negligence.
– Sign the boat rental contract (if required), including a declaration of swimming ability and fitness to operate the vessel and use the equipment involved.
– Arrive at the meeting point at least 30 minutes before the tour departure; otherwise, participation in the tour will not be possible.

8. Exclusion from Activities
Capri Hydro staff has the right to exclude from the scheduled activity anyone who:
– Displays poor health and inadequate physical preparation for the activity.
– Does not know how to swim.
– Fails to follow given instructions.
– Endangers their own safety or that of others through reckless and irresponsible actions.
– Voluntarily decides to leave the group in the presence of witnesses. Exclusion from the activity releases Capri Hydro and its staff from any liability towards the excluded participant. If the excluded participant is a minor, the parent/guardian who signed the registration form will also be excluded. No refunds will be given to excluded participants or those who voluntarily leave the excursion.

9. Insurance Policy
The boats are covered by the following insurance policy: Third-Party Liability (RCT) for damages to third parties, excluding compensation for the responsible operator. Insurance policy: AXA Assicurazioni S.P.A., policy no. 411294251.

10. Complaints
Any complaints regarding the services offered must be promptly reported to the Provider to enable a quick resolution. Formal complaints can be sent via email to info@caprihydro.com within 24 hours of the activity date.

11. Privacy
Personal data collected during the booking process will be processed in accordance with our Privacy Policy, available on the website.

12. Governing Law and Jurisdiction
These Terms are governed by Italian law. Any disputes arising from these Terms or related to the services offered shall be subject to the exclusive jurisdiction of the Court of Naples.

13. Changes to the Terms
Capri Hydro reserves the right to modify these Terms at any time. Changes will be effective from the date of publication on the website. It is recommended to check the Terms periodically for updates.
